It imposes a civil penalty for violations of the provisions in this law. Consumers should be clearly informed about their right to opt out of targeted advertising, personal information sales, and profiling in the privacy notice.<\/p>\n<p>The opt-out mechanism must:<\/p>\n<ul class=\"pt-[9px] pb-[2px] pl-[24px] list-disc [&amp;_ul]:pt-[5px] pt-[5px]\">\n<li class=\"text-body font-regular text-gray-800 leading-[24px] my-[5px] [&amp;&gt;ol]:!pt-0 [&amp;&gt;ol]:!pb-0 [&amp;&gt;ul]:!pt-0 [&amp;&gt;ul]:!pb-0\" value=\"1\">Not unfairly disadvantage another controller.<\/li>\n<li class=\"text-body font-regular text-gray-800 leading-[24px] my-[5px] [&amp;&gt;ol]:!pt-0 [&amp;&gt;ol]:!pb-0 [&amp;&gt;ul]:!pt-0 [&amp;&gt;ul]:!pb-0\" value=\"2\">Require an affirmative, freely given, and unambiguous choice to opt-out.<\/li>\n<li class=\"text-body font-regular text-gray-800 leading-[24px] my-[5px] [&amp;&gt;ol]:!pt-0 [&amp;&gt;ol]:!pb-0 [&amp;&gt;ul]:!pt-0 [&amp;&gt;ul]:!pb-0\" value=\"3\">Be consumer-friendly and easy to use.<\/li>\n<\/ul>\n<p>Covered organizations must recognize the required opt-out mechanism by January 1, 2025.<\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Policies &amp; notices<\/h4>\n<p><span style=\"font-weight: 400;\">Organizations must give consumers an accessible, clear privacy notice. It should outline the types of personal and sensitive information collected, shared with third parties, the purposes of processing this data, and how consumers can exercise their rights. If a business sells any of the following data, it must inform consumers clearly, using a notice similar to the privacy notice, accessible via a link on the homepage:<\/span><\/p>\n<ul>\n<li>Sensitive personal information &#8211; &#8220;NOTICE: We may sell your sensitive personal data.&#8221;<\/li>\n<li>Biometric data &#8211; &#8220;NOTICE: We may sell your biometric personal data.&#8221;<\/li>\n<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t<\/section>\n\t\n\n\t<section id=\"block_634de46522b45471ea30855192dd647f\" class=\"columns-two\" style=\"padding-top:0;\">\n\t\t<div class=\"container\">\n\t\t\t\t\t\t<div class=\"col-wrap\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Data subject rights &amp; requests<\/h4>\n<p>Consumers have the right to access, correct, delete, opt out of processing, and exercise data portability for their personal information. Businesses must address these requests within 45 days without undue delay. It does not include de-identified data or publicly available information.<\/p>\n<p>Sensitive personal information is a category of personal information revealing (a) racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexuality, or citizenship or immigration status; (b) genetic or biometric data that is processed for the purpose of uniquely identifying an individual; (c) personal data collected from a known child; or (d) precise geolocation data.
