This legislation amends ORS 180.095, known as the Department of Justice Protection and Education Revolving Account and outlines the obligations and standards of privacy protection that apply to covered entities.<\/p>\n\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t\t<section id=\"block_24a97ab0344be929668d6cff0fbd1d17\" class=\"columns-one text-left\" style=\"padding-bottom:0;overflow:hidden;\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t<h2 style=\"text-align: center\">Are you subject to the Oregon Consumer Data Protection Act?<\/h2>\n<p style=\"text-align: center\">The Oregon Consumer Data Protection Act applies to any organizations who do business in Oregon or provide products or services to Oregon residents and meet any of the following criteria during a calendar year:<\/p>\n<ul>\n<li>The personal information of 100,000 or more consumers, other than personal information controlled or processed solely for the purpose of completing a payment transaction<\/li>\n<li>The personal information of 25,000 or more consumers, while deriving 25 percent or more of the person\u2019s annual gross revenue from selling personal information.<\/li>\n<\/ul>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t\t<section id=\"block_3929ce8f158986ea9def51b300dd85e6\" class=\"features-section\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<div class=\"max-width text-center\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<h2>Obligations &amp; Rights under the Oregon Consumer Data Protection Act<\/h2>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<h5>This data privacy and protection law requires organizations to provide control and transparency to Oregon consumers on how their personal information is collected, sold, and disclosed.\r\n<\/h5>\n\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t<ul class=\"list-w-links two-cols\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"icon-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/trustarc.com\/wp-content\/uploads\/2024\/02\/icon_Consent.svg\" class=\"attachment-full size-full\" alt=\"\" \/>\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"h6 block\">Consents &amp; Opt-outs<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<p>Consumers\u2019 consent must be obtained before data processing and allow the consent to be revoked as easily as it was given. Consumers must be presented with a clear and conspicuous link to a webpage or by other means where they may opt out of targeted advertising, the sale of personal information, and profiling.<\/p>\n\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"icon-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/trustarc.com\/wp-content\/uploads\/2024\/02\/icon_Pages.svg\" class=\"attachment-full size-full\" alt=\"\" \/>\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"h6 block\">Policies &amp; Notices<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<p>Organizations must provide consumers with a reasonably accessible, clear, and meaningful privacy notice. This notice must include categories of personal and sensitive information collected and shared with third parties, the purposes of data processing, and instructions for exercising consumer rights. It excludes the content of communications, as well as any data generated by or associated with advanced utility metering infrastructure systems or equipment intended for utility use.
