The law also introduces a number of recordkeeping obligations.<\/p>\n\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t\t<section id=\"block_97850ce20838684ba892de56640983c0\" class=\"columns-one text-left\" style=\"\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t<h2 style=\"text-align: center\">Are you subject to the PDPA?<\/h2>\n<p style=\"text-align: center\">The Thailand PDPA applies to the collection, use, or disclosure of personal data by a controller or processor that is in the Kingdom of Thailand, regardless of whether such collection, use, or disclosure takes place in the Kingdom of Thailand or not.<\/p>\n<p style=\"text-align: center\">In the event that a controller or processor is outside the Kingdom of Thailand, the Act shall apply to the collection, use, or disclosure of personal data of data subjects who are in the Kingdom of Thailand, where the activities of such controller or processor include the following:<\/p>\n<ul>\n<li>the offering of goods or services to the data subjects who are in the Kingdom of Thailand, irrespective of whether the payment is made by the data subject\n<\/li>\n<li>the monitoring of the data subject\u2019s behavior, where the behavior takes place in the Kingdom of Thailand.\n<\/li>\n<\/ul>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t<section id=\"block_75637e3f3cc0e733aff7b271423bbcd7\" class=\"columns-two\" style=\"padding-bottom:0;\">\n\t\t<div class=\"container\">\n\t\t\t\t\t\t\t<div class=\"heading text-center max-width\">\n\t\t\t\t\t\t\t\t\t\t\t<h2>Obligations &amp; Rights under the Thailand\u2019s PDPA<\/h2>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"col-wrap\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Consents &amp; Opt-outs<\/h4>\n<p>Consent is required before collecting, using, or disclosing personal data, with individuals informed about the purposes and details of data handling. Organizations must allow easy withdrawal of consent and halt further data processing. The Act sets specific consent rules for minors\u2019 data.
