{"id":3591,"date":"2024-03-12T11:18:44","date_gmt":"2024-03-12T17:18:44","guid":{"rendered":"https:\/\/trustarc.com\/?post_type=regulations&#038;p=3591"},"modified":"2024-03-21T12:28:16","modified_gmt":"2024-03-21T18:28:16","slug":"ferpa","status":"publish","type":"regulations","link":"https:\/\/trustarc.com\/regulations\/ferpa\/","title":{"rendered":"Family Educational Rights and Privacy Act (FERPA)"},"content":{"rendered":"\t\t<section id=\"block_02c878a356be373be578a1e4b6ad75da\" class=\"hero-section-colors text-center bg-navy-gradient\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<span class=\"sub-title block font-bold \">Regulation<\/span>\n\t\t\t\t\t\t\t\t\t\t<h1>Family Educational Rights and Privacy Act (FERPA)<\/h1>\n\t\t\t\t\t<p>FERPA is a U.S. federal law that protects the privacy of students\u2019 education records by bestowing parents and\/or eligible students with more autonomy over their education records, and prohibits educational institutions from disclosing personally identifiable information within education records without written consent from an eligible student and\/or parent.<\/p>\n\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t\t<section id=\"block_bd775d5712cba7f1142c568d24bb3198\" class=\"features-boxed\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<div class=\"max-width text-center\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<h2>Are you subject to FERPA?<\/h2>\n\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t<ul class=\"feature-list\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"wrap\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"icon\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/trustarc.com\/wp-content\/uploads\/2024\/02\/icon_Cost-Savings.svg\" class=\"attachment-full size-full\" alt=\"\" \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<p>FERPA applies to any public or private elementary, secondary, or post-secondary school, state or local education agency that receives funds from an applicable program of the U.S. Department of Education.<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"wrap\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"icon\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/trustarc.com\/wp-content\/uploads\/2024\/02\/icon_Reject.svg\" class=\"attachment-full size-full\" alt=\"\" \/>\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<p>Some parochial and private elementary and secondary schools may not receive funding under any program administered by the U.S. Department of Education, and are therefore not subject to FERPA.<\/p>\n\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t<section id=\"block_95c78cf9803da073476805736ba48d36\" class=\"columns-two\" style=\"padding-top:0;padding-bottom:0;\">\n\t\t<div class=\"container\">\n\t\t\t\t\t\t\t<div class=\"heading text-center max-width\">\n\t\t\t\t\t\t\t\t\t\t\t<h2>Key obligations of FERPA<\/h2>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"col-wrap\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Annual notifications<\/h4>\n<p>All educational agencies and institutions shall annually notify parents and\/or eligible students of their rights under FERPA, including the right to:<\/p>\n<ul>\n<li>Access student education records;<\/li>\n<li>Correct student education records;<\/li>\n<li>Partial control over the disclosure of personally identifiable information contained within their education records; and<\/li>\n<li>Consent to the disclosure of personally identifiable information contained within the education record.<\/li>\n<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Right to hearings<\/h4>\n<p>Educational agencies or institutions shall establish procedures to provide parents and\/or eligible students a hearing to challenge the content of the student&#8217;s education records where it is demonstrated that the education record is inaccurate or in violation of the privacy rights of the student. Educational agencies or institutions shall organize a hearing in a timely manner after it has received the request for a hearing.<\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t<\/section>\n\t\n\n\t<section id=\"block_2d3905ab8ceda3f3033fd9d119e82aaa\" class=\"columns-two\" style=\"padding-top:0;padding-bottom:0;\">\n\t\t<div class=\"container\">\n\t\t\t\t\t\t<div class=\"col-wrap\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"col\">\n\t\t\t\t\t\t\t<h4>Record retention<\/h4>\n<p>Educational agencies or institutions must retain a record of each access request to and each disclosure request of personally identifiable information from students\u2019 education records. Educational agencies or institutions may disclose information from student records, without obtaining consent to third-parties and\/or circumstances allowed by FERPA.<\/p>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t<a href=\"#\" class=\"opener\">Does FERPA permit the disclosure of personally identifiable information from education records to officials of a state\u2019s juvenile justice system?<\/a>\n\t\t\t\t\t\t\t\t\t<div class=\"slide\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"slide-wrap\">\n\t\t\t\t\t\t\t\t\t\t\t<p>Yes. FERPA allows schools to non-consensually disclose such information from a student\u2019s education record to state and local officials or other authorities if the disclosure:<\/p>\n<ul>\n<li>Is permitted by a state law; and<\/li>\n<li>Concerns the juvenile justice system and its ability to serve the student whose records are disclosed.<\/li>\n<\/ul>\n<p>The officials and authorities, who will receive students\u2019 personally identifiable information, must disclose in writing to the school that the information will not be provided to any other party, except as provided under state law without written consent.<\/p>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t<a href=\"#\" class=\"opener\">How long does an educational agency or institution have to comply with a request to view records?<\/a>\n\t\t\t\t\t\t\t\t\t<div class=\"slide\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"slide-wrap\">\n\t\t\t\t\t\t\t\t\t\t\t<p>FERPA requires that access requests made by a parent or eligible student shall be provided within a reasonable period of time, but not more than 45 days after receipt of a request. Some States may require requests to be granted within a shorter time frame. <\/p>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t<a href=\"#\" class=\"opener\">Do students under the age of 18, not in college, and not in the physical care of a parent or guardian, have rights under FERPA?<\/a>\n\t\t\t\t\t\t\t\t\t<div class=\"slide\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"slide-wrap\">\n\t\t\t\t\t\t\t\t\t\t\t<p>FERPA does not explicitly grant minors, separated from their parents, the same rights that are granted to parents and eligible students under the Act. Alternatively, it is up to the school\u2019s discretion in determining whether an unaccompanied minor is responsible enough to exercise certain privileges (e.g. providing consent for disclosure).<\/p>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<li>\n\t\t\t\t\t\t\t\t\t<a href=\"#\" class=\"opener\">Can educational agencies or institutions request a fee from parents and\/or eligible students for copies of the student\u2019s education record?<\/a>\n\t\t\t\t\t\t\t\t\t<div class=\"slide\">\n\t\t\t\t\t\t\t\t\t\t<div class=\"slide-wrap\">\n\t\t\t\t\t\t\t\t\t\t\t<p>Yes. Educational agencies or institutions may charge a fee for copies of the student\u2019s education record.
