{"id":2981,"date":"2017-05-22T18:22:00","date_gmt":"2017-05-23T00:22:00","guid":{"rendered":"https:\/\/trustarc.com\/?post_type=resource&#038;p=2981"},"modified":"2024-12-18T13:49:01","modified_gmt":"2024-12-18T19:49:01","slug":"japan-act-on-the-protection-of-personal-information","status":"publish","type":"resource","link":"https:\/\/trustarc.com\/resource\/japan-act-on-the-protection-of-personal-information\/","title":{"rendered":"Changes to the Japan Act on the Protection of Personal Information"},"content":{"rendered":"\t\t<section id=\"block_e580a1378a572634dbcc123518e428f2\" class=\"resource-intro intro-simple\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<strong class=\"sub-title block uppercase\">Articles<\/strong>\n\t\t\t\t\t\t\t\t\t\t<h1>Changes to the Japan Act on the Protection of Personal Information<\/h1>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t<section id=\"block_1028a06bc288e2d8d45d9153e40995a2\" class=\"columns-content\">\n\t\t<div class=\"container\">\n\t\t\t<div class=\"left\">\n\t\t\t\t\t\t<div class=\"person-wrap\">\n\t\t\t<span>\t\t\t\t\t\t\t<div class=\"img-holder\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"110\" height=\"110\" src=\"https:\/\/trustarc.com\/wp-content\/uploads\/2024\/02\/people-placeholder-lt-blue.png\" class=\"attachment-full size-full wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<div class=\"text-holder\">\n\t\t\t\t\t\t\t\t\t\t\t<strong class=\"block name\">Annie Greenley-Giudici<\/strong>\n\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/span>\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t<div class=\"middle\">\n\t\t\t\t<div class=\"content\">\n\t\t\t\t\t<h2>Japan\u2019s Act on the Protection of Personal Information (APPI) and APEC CBPRs<\/h2>\n<p>In September 2016, Japan passed the\u00a0<a href=\"https:\/\/www.ppc.go.jp\/files\/pdf\/280222_amendedlaw.pdf\">\u201cAmended Act on the Protection of Personal Information (APPI)<\/a>\u201d with implementing regulations released in January 2017.<\/p>\n<p>The final revised law went into effect on Tuesday, May 30, 2017.<\/p>\n<h3>Key changes under the Japan Act on the Protection of Personal Information<\/h3>\n<p>Key changes under the new law include:<\/p>\n<ul>\n<li><strong>Establishment of the Personal Information Protection Commission (PPC):<\/strong>\u00a0The new PPC serves as the central supervisory authority for the APPI.\u00a0 Previous authority was divided across multiple regulatory authorities by sector.<\/li>\n<li><strong>Establishment of a Legal Framework for Anonymously Processed Information:\u00a0<\/strong>The revised APPI provides specific guidance on using anonymized data (including approved methods for anonymizing data).<\/li>\n<li><strong>Response to Globalization of Data Flows:<\/strong>\u00a0<strong>\u00a0<\/strong>New restrictions on international transfers, PPC enforcement and investigative cooperation with foreign enforcement authorities, and the extraterritorial application of the APPI have also been included.<\/li>\n<\/ul>\n<h3>The role of APEC CBPRs in the APPI<\/h3>\n<p>Article 24 of the APPI imposes restrictions on the transfer of personal information of Japanese citizens to third parties in foreign countries.<\/p>\n<p>Exemptions to these restrictions include when a third party has established a system that meets the Rules of the Commission to \u201ccontinuously implement equivalent necessary measures.\u201d<\/p>\n<p>The regulations for implementing Article 24 specifically call out a company\u2019s APEC Cross Border Privacy Rules (CBPR) certification as satisfying this requirement.<\/p>\n<p><strong>Most importantly, the APPI allows the data controller\u00a0<em>or<\/em>\u00a0the data processor to meet this requirement through CBPR certification.<\/strong><\/p>\n<p>As such, your company\u2019s CBPR certification will permit you to both transfer and receive personal information under the APPI.<\/p>\n<p>In March 2016, the Japanese Institute for the Promotion of Digital Economy and Communication was approved to serve as an accountability agent under the CBPR system.<\/p>\n<p>The Japanese Institute joins TrustArc, who was<a href=\"https:\/\/www.marketwired.com\/press-release\/truste-named-first-accountability-agent-for-apec-cross-border-privacy-1805228.htm\">\u00a0named the first accountability agent for APEC Cross Border Privacy compliance<\/a>\u00a0in June 2013.<\/p>\n<p>The CBPR system was endorsed by APEC member economies in 2012 for businesses established in the APEC region that collect and transfer personally identifiable information from consumers.<\/p>\n<p>CBPR implementation has continued to gain momentum recently, with South Korea submitting its application to join the system in January and Singapore and the Philippines announcing their intention to do the same later this year.<\/p>\n<p>TrustArc was named the first accountability agent for the system in June 2013.
