It is managed by the U.S. Federal Trade Commission (FTC).<\/p>\n<p>While COPPA focuses on restricting the collection and\/or distribution of children\u2019s personal data, it also sets rules for how organizations must get verifiable parental consent when children use online services.<\/p>\n<p>In essence, COPPA protects children\u2019s privacy by giving parents control over their children\u2019s online activities.<\/p>\n<p>The Code of Federal Regulations Part 312.1 scope notes:<\/p>\n\t\t\t\t\t\t\t\t<blockquote class=\"w-indent\">\n\t\t\t\t\t\t\t\t\t<p>\u201cThis part implements the Children\u2019s Online Privacy Protection Act of 1998 (15 U.S.C. 6501), which prohibits unfair or deceptive acts or practices in connection with the collection, use, and\/or disclosure of personal information from and about children on the Internet.\u201d<\/p>\n\t\t\t\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t\t\t<p>The FTC revised COPPA in 2012 to strengthen children\u2019s privacy and give parents more control over the collection of personal information from children. This revision expanded the coverage of COPPA to include apps, plugins, and devices that can connect to online services.<\/p>\n<h3>How to access the text of the COPPA<\/h3>\n<ul>\n<li>Read the\u00a0<a href=\"https:\/\/www.ecfr.gov\/current\/title-16\/chapter-I\/subchapter-C\/part-312\" target=\"_blank\" rel=\"noopener\">full text of the COPPA<\/a>\u00a0via the Code of Federal Regulations in the target=\"_blank\" rel=\"noopener\">FTC\u2019s explanation of COPPA<\/a>.<\/li>\n<\/ul>\n<h2>Why was COPPA created?<\/h2>\n<p>Unauthorized access and misuses of personal information emerged as a major concern in the 1990s, as the internet became more popular.<\/p>\n<p>Commercial websites began to be criticized for the way they targeted children with advertising, as well as for collecting children\u2019s personal data without parental knowledge or consent.<\/p>\n<p>In 1996, the Center for Media Education (CME) asked the FTC to investigate some high-profile websites aimed at children, amid claims some sites were using unfair and deceptive practices in their marketing to children.<\/p>\n<p>The CME\u00a0<strong>published research showing children did not understand privacy risks and were typically very na\u00efve about the dangers of sharing personal information online.\u00a0<\/strong><\/p>\n<p>In 1997, following the passing of the\u00a0<a href=\"https:\/\/epic.org\/dppa\/\" target=\"_blank\" rel=\"noopener\">Driver\u2019s Privacy Protection Act<\/a>, the FTC reported that websites aimed at children could be regulated, and operators of these websites were told they need to inform parents about the privacy risks for children sharing personal information online.<\/p>\n<p>The FTC\u2019s guidelines for managing parental consent eventually became law with COPPA.<\/p>\n<h2>How is COPPA designed to protect children\u2019s privacy?<\/h2>\n<p>Under COPPA, parents must be given control of their children\u2019s online activities by the operators of a commercial website or online service.<\/p>\n<ul>\n<li>Parents have the right to be provided with a description of the types of personal information collected from children by the operator.<\/li>\n<li>Parents must be informed about the privacy policy.<\/li>\n<li>The privacy policy must be posted anywhere the operator intends to collect, retain and\/or disclose personal information about children.<\/li>\n<li>Operators must get verifiable consent from the parents\u00a0<i>before<\/i>\u00a0collecting or using any personal information about their children.<\/li>\n<li>Parents have the right to monitor their children\u2019s activities and review any personal information collected from their children.<\/li>\n<li>Parents have the right to request deletion of their children\u2019s personal information.<\/li>\n<li>Parents have the right to withdraw permission at any time for the collection and\/or use of their children\u2019s personal information.<\/li>\n<\/ul>\n<h3>Does COPPA apply if children can voluntarily share information?<\/h3>\n<p>COPPA applies whether:<\/p>\n<ul>\n<li>A child is prompted or encouraged to share personal information to use a service or participate in an activity, or<\/li>\n<li>A child voluntarily posts personal information publicly.<\/li>\n<\/ul>\n<p><strong>In all cases, verifiable parental consent is required.<\/strong><\/p>\n<h3>Does COPPA apply to personal information about children collected from parents?<\/h3>\n<p>While COPPA only applies to the collection of personal information from children, the FTC noted in its\u00a0<a href=\"https:\/\/www.ftc.gov\/policy\/federal-register-notices\/childrens-online-privacy-protection-rule-16-cfr-part-312-4\" target=\"_blank\" rel=\"noopener\">1999 Statement of Basis and Purpose<\/a>\u00a0it also expects all operators to keep confidential any information collected from parents while:<\/p>\n<ul>\n<li>Obtaining parental consent<\/li>\n<li>Giving the parent access to review a child\u2019s online activities.<\/li>\n<\/ul>\n<h2>Who is covered by COPPA?<\/h2>\n<p>COPPA applies to U.S. and international operators of commercial websites and online services that target children in the U.S. and collect personal information from them.<\/p>\n<p>It also applies to organizations with \u2018actual knowledge\u2019 that they collect and\/or retain personal information from users of websites or online services directed to children.<\/p>\n<p><strong>If the personal information of children in the U.S. can be or is collected by an operator of an online service, then COPPA applies<\/strong>\u00a0\u2013 regardless of where the operator is based.<\/p>\n<p>If a commercial organization wants to collect personal information about U.S.-based children, then informed and verifiable parental consent is required.<\/p>\n<p><strong>COPPA\u2019s coverage includes:<\/strong><\/p>\n<ul>\n<li>Commercial websites directed to children, including sites promoting and\/or selling products or services aimed at children<\/li>\n<li>U.S. Federal Government websites and online services, along with any websites or online services operated by federal government contractors<\/li>\n<li>Internet-enabled gaming platforms<\/li>\n<li>Internet-connected mobile apps and software<\/li>\n<li>Internet-enabled devices, such as toys and smart home speakers<\/li>\n<li>Any technology that can be used to track location via the internet.<\/li>\n<\/ul>\n<p>In some cases, where it\u2019s clear children are the target audience, COPPA also applies to third-party providers of online services, such as ad networks and plugins that can collect, process and\/or retain personal information (again, regardless of where these third parties are located).<\/p>\n<h3>Which kinds of websites and online services does COPPA not apply to?<\/h3>\n<p>COPPA does not apply to non-profit organizations operating websites or other online services. They are exempt under Section 5 of the FTC Act \u2013 unless they collect and use children\u2019s personal information for any commercial purpose.<\/p>\n<h2>What are some signs a website or online service is \u2018directed to children\u2019?<\/h2>\n<p>COPPA outlines several factors to determine whether commercial websites or online services (including apps and internet-enabled toys and devices) are directed to (i.e. appeal to) children, including:<\/p>\n<ul>\n<li>Subject matter and language (i.e. lower reading-age vocabulary, or using phrases that engage children)<\/li>\n<li>Visual content: especially animated characters, young models or celebrities<\/li>\n<li>Child-oriented games, activities and incentives<\/li>\n<li>Music or audio, such as catchy tunes<\/li>\n<li>Advertisements for products or services aimed at children.<\/li>\n<\/ul>\n<p>Additionally, a site or service can be considered as \u2018directed to children\u2019 if any competent and reliable empirical evidence shows:<\/p>\n<ul>\n<li>Children are the intended audience or a key segment<\/li>\n<li>Children regularly visit the website or service because it contains content that appeals to them.<\/li>\n<\/ul>\n<h2>What is considered \u2018personal information\u2019 of children under COPPA?<\/h2>\n<p>Personal information is any data, opinion or other information about an individual that could identify them.<\/p>\n<p>Under COPPA, children\u2019s personal information is defined as including any information provided by them, their parents or a third party, whether directly or by tracking their actions or participation in activities.<\/p>\n<p>COPPA defines children\u2019s personal information to include:<\/p>\n<ul>\n<li>First and last name<\/li>\n<li>Address of a child\u2019s home or other physical location where they spend time, including names of streets, cities or towns<\/li>\n<li>Geolocation data sufficient to identify the name of a street and city or town where the child has spent time<\/li>\n<li>Telephone number\/s<\/li>\n<li>Online contact information, such as an email address, username or screen name<\/li>\n<li>Persistent online identifiers, such as a profile, cookie, IP address, device serial number or other identifier to recognize a user over time and across different online locations, websites or services<\/li>\n<li>Any visual record (photo, video) or audio record containing a child\u2019s image and\/or voice<\/li>\n<li>Any personal information about the child\u2019s parents, family members or friends.<\/li>\n<li>Any information about the child or the child\u2019s parents that the operator collects from the child and combines with an identifier.<\/li>\n<\/ul>\n<h3><strong>Decades of expertise in COPPA compliance<\/strong><\/h3>\n<p>TrustArc has a long history of helping businesses comply with privacy regulations and verify compliance.<\/p>\n<p>Our organization was founded in 1997 as a non-profit industry association called TRUSTe.
