Children\u2019s privacy regulations are not new. However, they\u2019ve come a long way since the Family Educational Rights and Privacy Act (FERPA) was passed in 1974 and the<a href=\"\/regulations\/coppa\/\" target=\"_blank\" rel=\"noopener\"> Children\u2019s Online Privacy Protection Act (COPPA)<\/a> in 1998.<\/p>\n<p>Children have been using the internet daily to learn and entertain themselves for decades. Yet the necessary safeguards to protect kids\u2019 privacy are missing from most websites, apps, and other technologies. Recently, the <a href=\"https:\/\/ico.org.uk\/media\/for-organisations\/guide-to-data-protection\/key-data-protection-themes\/age-appropriate-design-a-code-of-practice-for-online-services-2-1.pdf\" target=\"_blank\" rel=\"noopener\">UK Age Appropriate Design Code Act 2021<\/a> set out to change this and paved the way for new legislation based on higher standards for applying data protection laws to children and digital services.<\/p>\n<p>These standards apply not only to U.K. websites but to any website or app accessible by children in the UK \u2013 whether it\u2019s meant for children to use or not. The UK Age Appropriate Design Code became effective on 9\/2\/20 with a 12-month transition period.<\/p>\n<p>Inspired by the UK, California was the first U.S. state to pass an <a href=\"https:\/\/trustarc.com\/blog\/2023\/02\/22\/california-age-appropriate-design-code-act\/\">Age-Appropriate Design Code Act (AB-2273)<\/a> to protect children\u2019s privacy. Like the UK code, it\u2019s designed to ensure technology companies proactively take a privacy-by-design and default approach to protect children\u2019s privacy and safety when creating or updating online services, products, or features that children will likely access.<\/p>\n<h2>The gap in U.S. children\u2019s privacy regulations<\/h2>\n<p>Unlike the U.S. <a href=\"https:\/\/trustarc.com\/blog\/2023\/01\/12\/coppa-compliance-made-easy-keep-kids-in-mind\/\">Children\u2019s Online Privacy Protection Act (COPPA)<\/a>, which provides protection for children aged 13 or under, the CA Kids Code is designed to protect all children under 18 in California. Yet there is no federal regulation to protect children between the ages of 13 and 18.<\/p>\n<p>Despite existing legal protections, Meta <a href=\"https:\/\/www.cnn.com\/2023\/04\/19\/tech\/meta-horizon-worlds-virtual-reality-teens\/index.html\">continues its plans<\/a> to let American and Canadian teenagers into its <a href=\"https:\/\/trustarc.com\/resource\/privacy-augmented-virtual-reality-platforms\/\" target=\"_blank\" rel=\"noopener\">virtual reality app<\/a>, Horizon Worlds. The app currently allows people 17 and up to physically interact with each other in virtual spaces resembling real life.<\/p>\n<p>Meta claims it will use privacy by default guidelines to protect children, but this is one of many platforms to watch. Gaming platforms and apps have <a href=\"https:\/\/www.privo.com\/history-of-coppa-violations#:~:text=The%20FTC%20enforces%20COPPA%20violations,over%20which%20they%20have%20jurisdiction.\">consistently violated children\u2019s privacy regulations<\/a> such as COPPA.<\/p>\n<h2>Protecting kids online: The latest design codes and regulations to consider<\/h2>\n<p>There\u2019s more happening with children\u2019s privacy regulations than the two Acts in the UK and California. Regulators, including the FTC, have warned that they will focus on children\u2019s privacy. <a href=\"https:\/\/www.cooley.com\/news\/insight\/2022\/2022-05-27-ftc-edtech-providers-coppa-enforcement\" target=\"_blank\" rel=\"noopener\">All 5 FTC commissioners<\/a> said they would begin to crack down on companies that illegally surveil children online.<\/p>\n<p>While some geographies, such as <a href=\"https:\/\/www.oaic.gov.au\/privacy\/your-privacy-rights\/more-privacy-rights\/children-and-young-people\" target=\"_blank\" rel=\"noopener\">Australia<\/a> and Canada, don\u2019t discriminate between children and adults regarding their data protection laws, the GDPR only protects children\u2019s information until they are 16 years old.<\/p>\n<p>As recently as October 2022, <a href=\"https:\/\/www.jdsupra.com\/legalnews\/congress-to-ftc-please-update-the-coppa-5251093\/\" target=\"_blank\" rel=\"noopener\">members of Congress have begged the FTC<\/a> to make updating COPPA a priority. Although it protects the children\u2019s privacy for those under 13, it hasn\u2019t been updated since 2013 and does not cover information collected from adults that may pertain to children.<\/p>\n<p>But because updating <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/1628\/text\" target=\"_blank\" rel=\"noopener\">COPPA failed to make it to Congress\u2019 2023 fiscal plan<\/a>, many states have taken it upon themselves to enact legislation to protect children\u2019s privacy better online. States with active children\u2019s privacy regulations in 2023 include:<\/p>\n<ul>\n<li>Utah<\/li>\n<li>Arkansas<\/li>\n<li>Oregon<\/li>\n<li>Nevada<\/li>\n<li>Texas<\/li>\n<li>Kansas<\/li>\n<li>Minnesota<\/li>\n<li>Illinois<\/li>\n<li>South Caroline<\/li>\n<li>Floria<\/li>\n<li>New Jersey<\/li>\n<li>Maryland<\/li>\n<li>Connecticut<\/li>\n<li>New York<\/li>\n<\/ul>\n<p>New legislation to protect children\u2019s privacy was also attempted in New Mexico, West Virginia, and Virginia but didn\u2019t pass.<\/p>\n<p>Although talks of updating COPPA have stalled, there\u2019s still much focus on protecting kids\u2019 privacy online nationwide. Again, President Joe Biden demanded a ban on online ads targeting children during his SOTUA in February 2023. And beyond the President, Senate leader Chuck Schumer is <a href=\"https:\/\/news.bloomberglaw.com\/privacy-and-data-security\/kids-online-safeguards-set-to-advance-as-schumer-eyes-june-vote\" target=\"_blank\" rel=\"noopener\">seeking a June vote on children\u2019s online protection legislation<\/a>.<\/p>\n\t\t\t\t\t\t\t\t<blockquote class=\"is-quote\">\n\t\t\t\t\t\t\t\t\t<p>We must finally hold social media companies accountable for the experiment they are running on our children for profit. And it&#8217;s time to pass bipartisan legislation to stop Big Tech from collecting personal data on kids and teenagers online. Ban targeted advertising to children!<\/p>\n\t\t\t\t\t\t\t\t\t\t<cite>&#8211; President, Joe Biden<\/cite>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t\t\t<p>Other federal Acts various representatives are still trying to bring to the table include <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/3538\" target=\"_blank\" rel=\"noopener\">EARN IT<\/a>, KOSA, and <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/395#:~:text=This%20bill%20allows%20individuals%20over,that%20is%20directed%20to%20children.&amp;text=provide%20written%20confirmation%20of%20deletion.\" target=\"_blank\" rel=\"noopener\">Clean Slate for Kids Online Act<\/a>. While we don\u2019t know which Act will gain momentum,<strong> Congress members enthusiastically support new children\u2019s privacy regulations.<\/strong><\/p>\n<h2>Two States pass children\u2019s social media Bills<\/h2>\n<p>In March 2023, the Governor of Utah signed the <a href=\"https:\/\/socialmedia.utah.gov\/\" target=\"_blank\" rel=\"noopener\">Utah Social Media Regulation Act<\/a>, which requires minors to obtain the consent of a guardian before joining social media platforms. Effective March 2024, this is one of the most aggressive steps so far by U.S. lawmakers to protect kids online.<\/p>\n<p>The Utah Act requires social media platforms to conduct age verification for all Utah residents, ban all ads for minors, and impose a curfew between the hours of 10:30 pm \u2013 6:30 am making the site off-limits for anyone under the age of 18. And despite much controversy, it also requires social platforms to give parents or guardians access to their teens\u2019 accounts.<\/p>\n<p>Within a month, Governor Sarah Huckabee Sanders approved similar legislation in Arkansas. The Arkansas law will apply to new accounts starting September 01, 2023. Senator Tyler Dees, the Arkansas bill\u2019s sponsor, said the new law \u201csends a clear message that we want to partner with parents and empower them to protect our children.\u201d<\/p>\n<p>It is likely other States will continue to pass similar legislation. However, privacy and free speech experts <a href=\"https:\/\/cdt.org\/insights\/cdt-civil-rights-orgs-urge-congress-to-not-advance-kosa-detailing-continued-risks-to-minors-and-lgbtq-teens\/\" target=\"_blank\" rel=\"noopener\">have raised concerns about the potential harms<\/a> of <a href=\"https:\/\/www.politico.com\/news\/2023\/04\/11\/social-media-privacy-parents-kids-00091400?mkt_tok=MTM4LUVaTS0wNDIAAAGLFYzpR0aa9uwlTnvjNCDlPtf1Qr4eODsx-UpsHHrz2Nns_NnZlYIML05U2Zhwz-cRwccosrc56gGBZKZsYChnUZ9VEU9LlXt9oXkxIVWL1vsz\" target=\"_blank\" rel=\"noopener\">surveillance and censorship<\/a> due to proposed children\u2019s online safety legislation.<\/p>\n<p>At the same time, parents and guardians must consider whether the benefits outweigh the cost, as increased social media use has led to significant negative consequences for teenagers and young adults. The hope is that bills like these will successfully reduce harm to children from social media use.<\/p>\n<h2>Key takeaways from the latest children\u2019s privacy regulations<\/h2>\n<p>While each regulation has its nuances, in general, the following takeaways can help businesses design the appropriate systems to protect children online:<\/p>\n<h3>Practice privacy by default and privacy by design<\/h3>\n<p>Design new products and services to <a href=\"https:\/\/trustarc.com\/blog\/2022\/10\/25\/7-privacy-by-design-guidelines\/\">consider data privacy proactively<\/a>. For existing services, set default settings that automatically offer users a high level of privacy. Require explicit consent for any data collection or processing activities. And don\u2019t track users unless they opt-in to tracking \u2013 especially users under 18 years of age.<\/p>\n<h3>Avoid dark patterns<\/h3>\n<p>A <a href=\"\/resource\/ux-dark-patterns-consent-data-collection\/\">dark pattern<\/a> is a term describing a variety of manipulative design choices to persuade users to make a decision they wouldn\u2019t have otherwise made. They can include pre-selections on forms, not giving people opt-out options, hidden opt-out controls, repetitive attempts to collect information or turn on tracking, and using algorithms to change purchase decisions.<\/p>\n<p>Using dark patterns is prohibited under the California Age-Appropriate Design Code Act and other data protection laws.<\/p>\n<h3>Conduct data protection impact assessments with kids in mind<\/h3>\n<p>Conducting data protection impact assessments (DPIAs) is required for businesses under California\u2019s new child design law for any new online service, product, or feature likely to be accessed by children before it is offered to the public. And the DPIAs must be maintained as long as the online service, product, or feature is available.<\/p>\n<p>DPIAs are also a key part of compliance with the GDPR and, thus, the UK Age Appropriate Design Code. The business must identify the purpose of its service, whether it collects children\u2019s personal information and how it\u2019s used, and the risks of harm to children that the data management practices of the business could cause.<\/p>\n<p>Analyze any harmful content, (addictive) features, or algorithms that children could access. While this may sound counterintuitive, that is the framework these Acts use.<\/p>\n<p>Consider the impact on the child\u2019s physical health, mental health, and wellbeing. And avoid using data in ways that would have any negative impacts on those areas. If you can\u2019t do so, you must find a way to block children from accessing your product or service or risk significant fines or penalties and ongoing compliance program requirements.<\/p>\n<h3>Minimize data collection<\/h3>\n<p>Reduce risk effectively by only collecting data that is absolutely necessary for business functions. Rather than collecting more data, focus on collecting the highest quality data with consent.<\/p>\n<p>Don\u2019t collect precise geolocation collection (except if explicitly necessary). And review your data retention policies to see if there\u2019s room to reduce the amount of time or amount of data retained. As we see more data protection laws for children and adults, <a href=\"\/resource\/data-minimization-gdpr-ccpa-privacy-laws\/\">data minimization<\/a> can drastically simplify your data protection
