{"id":2242,"date":"2023-10-17T11:23:00","date_gmt":"2023-10-17T17:23:00","guid":{"rendered":"https:\/\/trustarc.com\/?post_type=resource&#038;p=2242"},"modified":"2024-10-03T11:43:27","modified_gmt":"2024-10-03T17:43:27","slug":"global-privacy-control-financial-incentives","status":"publish","type":"resource","link":"https:\/\/trustarc.com\/resource\/global-privacy-control-financial-incentives\/","title":{"rendered":"Bridging the Gap: Global Privacy Control and Financial Incentives"},"content":{"rendered":"\t\t<section id=\"block_66b597740b4ec375e98c5d805ab75fe2\" class=\"resource-intro intro-simple\">\n\t\t\t<div class=\"container\">\n\t\t\t\t\t\t\t\t\t<strong class=\"sub-title block uppercase\">Articles<\/strong>\n\t\t\t\t\t\t\t\t\t\t<h1>Bridging the Gap: Global Privacy Control and Financial Incentives<\/h1>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\n\n\t<section id=\"block_c4bbdee41ce4137f2903f5cd2851440f\" class=\"columns-content\">\n\t\t<div class=\"container\">\n\t\t\t<div class=\"left\">\n\t\t\t\t\t\t\t<\/div>\n\t\t\t<div class=\"middle\">\n\t\t\t\t<div class=\"content\">\n\t\t\t\t\t<p>Consumers who want to opt-out of the sale or sharing of their personal information can find it hard to exercise this important privacy right.<\/p>\n<p>An <a href=\"https:\/\/advocacy.consumerreports.org\/wp-content\/uploads\/2020\/09\/CR_CCPA-Are-Consumers-Digital-Rights-Protected_092020_vf.pdf\" target=\"_blank\" rel=\"noopener\">extensive study by Consumer Reports<\/a> about compliance issues related to the California Consumer Privacy Act noted:<\/p>\n\t\t\t\t\t\t\t\t<blockquote class=\"w-indent\">\n\t\t\t\t\t\t\t\t\t<p>\u201cConsumers struggled to locate the required links to opt-out of the sale of their information. For 42.5% of sites tested, at least one of three testers was unable to find a DNS (Do Not Sell) link. All three testers failed to find a \u201cDo Not Sell\u201d link on 12.6% of sites, and in several other cases, one or two of three testers were unable to locate a link.<\/p>\n\t\t\t\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t\t\t<p>The <a href=\"https:\/\/globalprivacycontrol.org\/\" target=\"_blank\" rel=\"noopener\">Global Privacy Control (GPC)<\/a> was designed to address this issue.<\/p>\n<p>GPC gives users a universal privacy control in a web browser extension, allowing them to store their choice to opt-out of having their data collected for sale or sharing before they interact with any business online.<\/p>\n<p>GPC was developed by a collective of technologists, researchers, civil rights activists, web publishers and representatives of several technology businesses (ranging from browser vendors and extension developers to software companies).<\/p>\n<p>Under the California Consumer Privacy Act (CCPA), California consumers\u2019 privacy right to opt-out was meant to be streamlined by requiring businesses to get consent from California consumers to share and\/or sell their personal information. CCPA includes a provision for opt-out to be signaled via Global Privacy Control settings in consumers\u2019 browsers, saving them from having to go through opt-out processes with every business they interact with online.<\/p>\n<h3>Global Privacy Control: Key dates<\/h3>\n<ul>\n<li><strong>November 14, 2011<\/strong> \u2013 A <a href=\"https:\/\/www.w3.org\/press-releases\/2011\/dnt\/\" target=\"_blank\" rel=\"noopener\">first draft of a \u201cDo Not Track\u201d (DNT) standard<\/a> for online privacy, also known as Tracking Preference Expression, is published by the World Wide Web Consortium (W3C), an organization developing open standards and guidelines for the web based on the principles of accessibility, internationalization, privacy, and security. A Tracking Protection Working Group is established to standardize DNT and the DNT header for browsers is supported in major web browsers including Chrome, Firefox, Internet Explorer, Opera and Safari.<\/li>\n<li><strong>January 18, 2019<\/strong> \u2013 the <a href=\"https:\/\/github.com\/w3c\/dnt\/commit\/5d85d6c3d116b5eb29fddc69352a77d87dfd2310\" target=\"_blank\" rel=\"noopener\">W3C Tracking Protection Working Group is closed<\/a>, with a statement from the group noting \u201csince its last publication as a Candidate Recommendation, there has not been sufficient deployment of these extensions (as defined) to justify further advancement, nor have there been indications of planned support among user agents, third parties, and the ecosystem at large.\u201d<\/li>\n<li><strong>October 2020<\/strong> \u2013 Global Privacy Control is introduced.<\/li>\n<li><strong>January 28, 2021<\/strong> \u2013 the GPC organization announces the <a href=\"https:\/\/globalprivacycontrol.org\/press-release\/20210128\" target=\"_blank\" rel=\"noopener\">browser signal is being used<\/a> by more than 40 million users and honored by major publishers such as The New York Times as \u201ca valid opt-out of sale under the CCPA\u201d.<\/li>\n<li><strong>August 14, 2022<\/strong> \u2013 the Office of the California Attorney General Rob Bonta, announces a CCPA enforcement <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-announces-settlement-sephora-part-ongoing-enforcement\" target=\"_blank\" rel=\"noopener\">settlement with Sephora<\/a>, which is <em>\u201cpart of ongoing efforts by the Attorney General to enforce California\u2019s comprehensive consumer privacy law that allows consumers to tell businesses to stop selling their personal information to third parties, including those signaled by the Global Privacy Control (GPC) \u2026 There are no more excuses. Follow the law, do right by consumers, and process opt-out requests made via user-enabled global privacy controls.\u201d<\/em><\/li>\n<\/ul>\n<h2>Lack of trust motivates opt-outs and GPC signals<\/h2>\n<p>Most people are now very aware they\u2019re tracked online and are becoming more active in adjusting privacy settings to exercise their personal privacy rights.<\/p>\n<p>Arguably the main reasons people opt-out of allowing their personal information to be collected, processed, sold and\/or shared are related to a lack of trust.<\/p>\n<p><strong>Worse case:<\/strong> people don\u2019t trust a business to protect their privacy at all. High profile data breaches have made them fearful, so some people lock down privacy settings whenever they\u2019re online, such as using a browser in private mode or connecting via a virtual private network.<\/p>\n<p><strong>Worst case:<\/strong> people don\u2019t trust a business to only use their personal information for relevant and useful purposes \u2013 and only then at times that suit the consumer.<\/p>\n<p>As a consumer, no doubt you\u2019re frequently targeted with supposedly \u2018relevant\u2019 offers or suggestions that miss the mark.<\/p>\n<p>Irrelevant intrusions from businesses you\u2019ve previously connected with can be irritating, but they\u2019re especially annoying when they\u2019re from businesses you have no relationship with at all. No one likes nuisance calls, spam, and other unsolicited communications from organizations you never wanted to share your contact information with, let alone allow them to know information that\u2019s more personal.<\/p>\n<p>So, it\u2019s not surprising more and more consumers actively seek and select stricter privacy settings \u2013 or choose GPC \u2013 in their efforts to stop apparently unsolicited and\/or irrelevant intrusions from businesses.<\/p>\n<p>However, <strong>GPC can mean consumers might inadvertently block themselves from the benefits of loyalty schemes and other financial incentive programs<\/strong> when they\u2019ve previously opted-in.<\/p>\n<h2>Businesses can build trust by demonstrating the benefits of opt-in<\/h2>\n<p>In our <a href=\"\/resource\/2023-global-privacy-benchmarks-report\/\" target=\"_blank\" rel=\"noopener\">2023 TrustArc Global Privacy Benchmark Report<\/a> we highlighted how more businesses are now onboard with maintaining brand trust through robust privacy efforts: <strong>the link between brand trust and proactive privacy measures rose in importance from 2022 to 2023, up seven points to 62%)<\/strong>.<\/p>\n<p>Trust can be built by continually demonstrating how consumer information is used for purposes that are relevant and beneficial for your customers.<\/p>\n<p>Under privacy regulations such as <a href=\"https:\/\/blog.trustarc.com\/2020\/07\/01\/california-consumer-privacy-act-ccpa-background-brief\/\">CCPA<\/a> and General Data Protection Regulation (<a href=\"https:\/\/blog.trustarc.com\/2022\/12\/14\/gdpr-schrems-ii-compliance-checklist\/\">GDPR<\/a>), consumers have a right to know what personal information is collected by a business and how it is used, shared or sold.<\/p>\n<p>When you ask customers to consent (via an opt-in mechanism) to having their data used, shared, or sold you must prove to them the relationship is worth maintaining. opt-out signal from their browser; and<\/li>\n<li>The signal conflicts with their existing participation in your business\u2019 financial incentive program, which requires opt-in to tracking technologies.<\/li>\n<li>Next, it should explain to the customer they can choose not to be tracked and, therefore, not participate in your incentive program anymore or continue to be tracked so they
