CCPA\/CPRA gives consumers the right to change their mind and withdraw consent (opt out) via forms on websites and apps or when a <a href=\"https:\/\/globalprivacycontrol.org\/\" target=\"_blank\" rel=\"noopener\">Global Privacy Control (GPC)<\/a> signal is detected.<\/p>\n<h2>Tech explained: What is global privacy control?<\/h2>\n<p>The GPC was designed to make it easy for individuals to tell businesses, <em>\u201cDo not sell or share my personal information\u201d<\/em>.<\/p>\n<p>It works as a universal opt-out mechanism to save consumers from having to click through notices or locate opt-out forms or pop-ups on individual websites they visit. They simply set up an Opt-out signal once in their preferred web browser or extension that supports GPC, such as <a href=\"https:\/\/disconnect.me\/\" target=\"_blank\" rel=\"noopener\">Disconnect<\/a>, <a href=\"https:\/\/spreadprivacy.com\/global-privacy-control-enabled-by-default\/\" target=\"_blank\" rel=\"noopener\">DuckDuckGo<\/a> Privacy Browser, <a href=\"https:\/\/blog.mozilla.org\/netpolicy\/2021\/10\/28\/implementing-global-privacy-control\/\" target=\"_blank\" rel=\"noopener\">Firefox<\/a>, or <a href=\"https:\/\/privacybadger.org\/\" target=\"_blank\" rel=\"noopener\">Privacy Badger<\/a> by the Electronic Frontier Foundation, and the extension helps them automatically exercise their privacy rights.<\/p>\n<h2>Privacy laws with global privacy control requirements<\/h2>\n<p>The California Consumer Privacy Act (<a href=\"https:\/\/blog.trustarc.com\/2020\/07\/15\/technical-brief-handling-ccpa-consumer-requests\/\" target=\"_blank\" rel=\"noopener\">CCPA<\/a>) and its amendments under the California Privacy Rights Act (<a href=\"https:\/\/blog.trustarc.com\/2023\/04\/13\/california-privacy-rights-act-cpra-technical-brief\/\" target=\"_blank\" rel=\"noopener\">CPRA<\/a>) require businesses to respect consumers\u2019 right to opt out from having their personal information sold or shared by a business to any other business.<\/p>\n<p>The <a href=\"https:\/\/www.oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/privacy\/oal-sub-final-text-of-regs.pdf\" target=\"_blank\" rel=\"noopener\">CCPA regulations (\u00a7999.315)<\/a> explicitly state <em>\u201ca business shall provide two or more designated methods for submitting requests to opt out, including an interactive form \u2026 and user-enabled global privacy controls, such as a browser plug-in or privacy setting, device setting, or other mechanism, that communicate or signal the consumer\u2019s choice to opt-out of the sale of their personal information\u201d.<\/em><\/p>\n<p>Other regulations, such as the <a href=\"https:\/\/blog.trustarc.com\/2021\/06\/16\/colorado-privacy-act-guide\/\" target=\"_blank\" rel=\"noopener\">Colorado Privacy Act<\/a> and the European Union\u2019s GDPR, are also set to include Global Privacy Control as an enforceable universal opt-out mechanism. The EU\u2019s GDPR, like California\u2019s CCPA\/CPRA, already requires businesses to get opt-in consent from consumers.<\/p>\n<p>In Colorado, businesses must give consumers easy access to opt-out mechanisms via privacy notices and in other conspicuous locations. From July 1, 2024, under the Colorado Privacy Act consumers will have the right to signal opt out from targeted advertising, profiling, and sale\/sharing of their personal data via (the Act\u2019s terminology) a \u2018Universal Opt-Out Mechanism\u2019 \u2013 such as Global Privacy Control \u2013 which will be enforceable in the state.<\/p>\n<h2>TrustArc technologies with \u2018GPC detected\u2019 and \u2018known user\u2019 features<\/h2>\n<p>TrustArc is very focused on helping businesses build and maintain positive customer relationships by providing best practices and compliant privacy consent management technologies.<\/p>\n<h3>TrustArc Customer Consent Preference Manager<\/h3>\n<p>We continue to develop new features in TrustArc&#8217;s <a href=\"\/products\/consent-consumer-rights\/consent-preference-manager\/\">Consent &amp; Preference Manager<\/a> to help businesses streamline the consent preference experience for customers, while staying abreast of updates to privacy laws such as CCPA\/CPRA with our centralized privacy regulation compliance platform.<\/p>\n<h3>TrustArc Financial Incentive Notice Service<\/h3>\n<p>The <a href=\"https:\/\/www.oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/privacy\/oal-sub-final-text-of-regs.pdf\" target=\"_blank\" rel=\"noopener\">CCPA regulations<\/a> state: <em>\u201cIf a global privacy control conflicts with a consumer\u2019s existing business-specific privacy setting or their participation in a business\u2019s financial incentive program, the business shall respect the global privacy control but may notify the consumer of the conflict and give the consumer the choice to confirm the business-specific privacy setting or participation in the financial incentive program.\u201d<\/em><\/p>\n<p>Configurable by TrustArc account managers, our <a href=\"https:\/\/blog.trustarc.com\/2023\/10\/17\/global-privacy-control-financial-incentives\/\" target=\"_blank\" rel=\"noopener\">Financial Incentive Notice<\/a> gives customers easy-to-understand choices about a financial incentive program that requires opt in to trackers:<\/p>\n<ul>\n<li><strong>Do not Participate<\/strong> \u2013 and therefore opt out of the financial incentive program and related tracking; or<\/li>\n<li><strong>Continue to participate<\/strong> \u2013 keeping the customer enrolled in the financial incentive program and therefore allowing the business to track the customer so it can continue to deliver marketing, discounts and\/or other customer loyalty benefits.<\/li>\n<\/ul>\n<h3>TrustArc Cookie Consent Manager \u2013 Unique known user feature<\/h3>\n<p>TrustArc\u2019s <a href=\"\/products\/consent-consumer-rights\/cookie-consent-manager\/\" target=\"_blank\" rel=\"noopener\">Cookie Consent<\/a> software accelerates the set up and management of complex cookie activities for businesses across all domains while ensuring compliance with privacy laws in all countries they operate in.<\/p>\n<p>Cookie Consent Manager includes features such as auto-detect for Global Privacy Control (GPC) signals \u2013 and the world\u2019s first CCPA\/CPRA-compliant Known User feature.<\/p>\n<p>TrustArc\u2019s Known User Feature addresses the <a href=\"\/regulations\/ccpa-cpra\/\">CPRA regulations<\/a> to CCPA that becomes enforceable on March 29, 2024, which requires businesses to record and remember a consumer\u2019s consent preferences across every device and browser they might use to provide a frictionless experience.<\/p>\n<p>The California Privacy Agency noted on February 3, 2023, in its <a href=\"https:\/\/cppa.ca.gov\/meetings\/materials\/20230203_item4_fsor.pdf\" target=\"_blank\" rel=\"noopener\">Final Statement of Reasons<\/a>: <em>\u201cSubsection (c)(1) has been modified to add language that the opt-out preference signal shall be treated as a valid request to opt out of sale\/sharing for any consumer profile, including pseudonymous profiles, that are associated with the browser or device for which the opt-out preference signal is given.<\/em><\/p>\n<p><em>\u201cAdditional language has also been included to further clarify that, if known, a business is also required to treat the opt-out preference signal as a valid request to opt-out of sale\/sharing for the consumer.<\/em><\/p>\n<p><em>\u201cThis change is necessary to address the realities of how the internet works, i.e., sometimes the business may only know the consumer pseudonymously and other times they may match the online actions with an offline consumer. This modification ensures that the opt-out preference signal applies to both situations.\u201d<\/em><\/p>\n<p>&nbsp;<\/p>\n\t\t\t\t\t\t\t\t<div
